With the passage of House Bill 542, you can now legally purchase and use certain fireworks in Pennsylvania. Residents are allowed to purchase Class C fireworks. These are also known as consumer grade fireworks. According to the Pennsylvania State Police, consumer grade fireworks include firecrackers, Roman candles, bottle rockets, and similar fireworks that contain a maximum of 50 milligrams of explosive material. On the other hand, display fireworks, which contain more than two grains or 130 milligrams of explosive materials, and professional-grade aerial shells containing more than 60 grams of pyrotechnic compositions, can still only be used by professionals with a permit.
To buy fireworks you must be 18 years old. Additional restrictions include that fireworks cannot be:
- used on public or private property without express permission of the property owner
- discharged from or within a motor vehicle or building nor discharged toward a motor vehicle or building
- discharged within 150 feet of an occupied structure, whether or not a person is actually present
- discharged while the person is under the influence of alcohol, a controlled substance, or another drug
