Coronavirus lawsuits

It is an unfortunate fact that large numbers of Pennsylvanians will soon be very sick, or even dead, as a result of the coronavirus pandemic. In these situations it will be crucial to preserve witnesses and evidence as soon as possible. The cases will be among the very most difficult to prove. At a minimum the person suing will need to establish that the defendant caused the transmission of the disease to the person who contracts the virus. Since the virus is all around us now that will be very difficult. If there are witnesses who know that a nursing home allowed someone to work there even though that person exhibited symptoms of illness, if someone came to work despite knowing he or she was feeling ill, if a business breaks quarantine rules, etc. those are the situations where investigators will need to preserve the statements of those witnesses as soon as possible. Let’s hope that our government finds a way to protect us that actually works. But assuming the obvious – that isn’t going to happen – people should contact us as soon as possible when there is a clear case of negligence in causing the transmission of the disease to an innocent party. We will only be accepting clear cases of negligence where a business or person clearly caused the transmission to another person under circumstances where it should have been avoided. Hopefully most people will do the right thing and such circumstances will be few and far between.
